By submitting content to Mohave Apparel, you represent and warrant that:
- You own the submitted content or have received permission from the legal owner to use and reproduce it.
- The content does not violate another party’s copyright, trademark, privacy, publicity, contractual, or other legal rights.
- You have obtained all required licenses, authorizations, permissions, and releases.
- The content is not illegal, fraudulent, threatening, defamatory, hateful, obscene, or otherwise prohibited by law.
- You accept responsibility for all claims arising from the content you submit.
You grant Mohave Apparel a limited, nonexclusive license to use, reproduce, resize, modify, digitize, print, embroider, and otherwise process the submitted content as necessary to prepare and complete your order.
Mohave Apparel is not responsible for independently determining ownership of customer-submitted content. We reserve the right to refuse or cancel any order that we reasonably believe may violate another party’s rights or applicable law.
The customer agrees to indemnify and hold harmless Ramak L.L.C., Mohave Apparel and Custom Printing, and their owners, employees, contractors, representatives, and affiliates from claims, damages, losses, liabilities, costs, and reasonable legal expenses arising from customer-submitted content or instructions.
PROOFS AND CUSTOMER APPROVAL
Customers are responsible for carefully reviewing all artwork proofs, digital mockups, embroidery previews, order details, and product specifications before granting approval.
Customers must verify:
- Spelling and grammar
- Names, numbers, dates, and contact information
- Artwork size and placement
- Garment type, color, and size
- Print and thread colors
- Quantities
- Personalization details
Once a proof is approved or production begins, changes may not be possible. Mohave Apparel is not responsible for mistakes contained in customer-provided artwork, customer instructions, or an approved proof.
Digital proofs are visual representations only. Colors displayed on a screen may vary from the colors of the completed product.
CUSTOM PRODUCT VARIATIONS
Custom printing and embroidery may involve minor variations in color, size, alignment, placement, texture, or appearance. Garments from different manufacturers or production batches may also vary slightly in shade, material, fit, or measurements.
Reasonable industry-standard variations are not considered defects.
Customers are responsible for reviewing available sizing information before ordering. Mohave Apparel does not guarantee that a garment will fit based only on a customer’s age, grade, usual size, or general description.
PRODUCT AVAILABILITY AND SUBSTITUTIONS
Products and garment styles are subject to supplier availability. When an ordered product is unavailable, we may contact the customer to discuss a comparable substitute, revised completion date, backorder, store credit, or refund for the unavailable item.
We will not substitute a materially different product without customer approval when approval is reasonably possible.
PRICING
Prices are subject to change without notice. Applicable taxes, shipping charges, digitizing fees, artwork fees, setup fees, personalization charges, rush fees, and other service charges may be added when applicable.
We reserve the right to correct pricing errors and cancel or adjust an order affected by an obvious website, system, or calculation error.
ORDER ACCEPTANCE
Submitting an order does not guarantee acceptance. We reserve the right to refuse, limit, suspend, or cancel an order because of:
- Product unavailability
- Payment problems
- Suspected fraud
- Artwork or legal concerns
- Production limitations
- Website or pricing errors
- Abusive or threatening conduct
- Circumstances outside our reasonable control
Custom orders may not be canceled after artwork has been approved, special-order merchandise has been purchased, digitizing has begun, or production has started.
Approved cancellations may be subject to charges for work already completed and expenses already incurred.
TURNAROUND TIMES
Production and completion dates are estimates unless a guaranteed deadline has been expressly accepted by Mohave Apparel in writing.
Delays may result from product availability, supplier delays, customer approval delays, shipping carrier issues, equipment problems, severe weather, emergencies, high order volume, or other circumstances outside our reasonable control.
Mohave Apparel is not responsible for indirect losses, missed events, lost profits, or other consequential damages resulting from a delayed order.
SHIPPING AND STORE PICKUP
Customers are responsible for providing accurate shipping, billing, contact, and pickup information.
After an order is transferred to a shipping carrier, delivery is subject to the carrier’s policies and schedule. Mohave Apparel is not responsible for carrier delays, incorrect addresses provided by the customer, theft following confirmed delivery, or events outside our control.
Store pickup customers should wait for confirmation that their order is ready before arriving. Proof of purchase or identification may be required.
RETURNS AND REFUNDS
Custom-printed, embroidered, personalized, altered, special-order, or otherwise decorated merchandise is generally nonreturnable and nonrefundable unless the product is defective or Mohave Apparel made an error that differs from the approved order.
Claims involving damaged, defective, missing, or incorrect merchandise should be reported promptly after delivery or pickup. Customers may be required to provide photographs and return the affected merchandise for inspection.
Any approved remedy may consist of repair, replacement, store credit, or refund, depending on the circumstances and applicable law.
Nothing in this notice limits any rights or remedies that cannot legally be waived under applicable consumer-protection laws.
